The computation of professional fees is governed by The Advocates Act Cap 267 and The Advocates (Remuneration and Taxation of costs) Rules. These Rules provide guidelines for computing fees for various legal services. However, the Advocates Act also gives us liberty to negotiate and agree on appropriate fees with our clients.

The firm’s legal services may be retained for general advisory and routine matters in order to enable the client make use of legal counsel without the necessity of raising an invoice for every piece of advice given and routine document drawn, perused or filed. The retainer fee covers professional fees only and is negotiable as between the client and the advocate. Clients often find this less costly and efficient in containing potential disputes since legal input is procured as often as necessary yet payment is fixed regardless of the frequency of consultation.

We can conclude retainer agreements for monthly legal fees. This may be appropriate in your case where the company requires frequent legal advice, some of which informal through telephone and e-mail. In such a case a time-sheet becomes difficult to keep because of the routine nature of legal consultation
